Our plan states I pick them up and she comes to get them when they are to return to her, however she refuses and I have done both for the last seven months. What are my options to getting her to follow our court parenting plan? What do you do when the mother of your children refuses to follow the parenting plan? about picking up our kid?
Keep a detailed record of every time you have had to pick them up and drop them off and take this to court, the judge could make her pay you for gas and wear and tear to the car. This will make her think twice about not following the plan. Last but not least enjoy the extra time you get with the kids during the car trips. There is a bright side to everything.
*Great I have a thumbs down fairy stalking me!! Look who ever you are grow up!!What do you do when the mother of your children refuses to follow the parenting plan? about picking up our kid?
First keep track of everytime you drop them off when she is supposed to pick them up.
Another option is not to take them back. If she calls the cops you can show them the plan and where it is her responsibility to come get them.
Last option is to file contempt charges against her using the evidence of her not coming to get them.
Well firstly you need to make it a legally binding agreement by having her sign a document saying that she will do x and Y and outlining the concequences of such a thing, if she then continues you will have a major foothold in the courts.
Remember it needs to be signed and dated by both of you and if possible get an indipendent person or neautral friend to co sign.
see your lawyer or take it back to court...if she refuses to pick them up i personally wouldnt take them back keep them with you...its in the plan she picks them up after they are with you..she fails to arrive so it isnt classed as kidnap, call her and she doesnt answer its only neglect on her part or sheer bitterness. dont let her get the better of you:)
If she's violating a court order...her rights can be revoked.
Keep note of every time she fails to fulfill her responsibilities as per the court agreement and the next time you go to court, or whenever you feel you've collected enough verifying evidence, bring it up tot he judge.
